4. SALES AND CONTRACT TERMS 4.1. Purpose These General Terms regulate the online contracting and use of the LOCK & GO IBIZA smart-locker service through the website www.lockandgoibiza.com, as well as the contractual relationship between LE MIRAGE IBIZA S.L. and the user who contracts the service. The service consists of the temporary rental of automated lockers for the storage of luggage and personal belongings, subject to the conditions, prices, schedules and limitations indicated on the website and in these terms. 4.2. The service LOCK & GO IBIZA offers users the possibility to reserve and use smart lockers of different sizes for natural-day periods or other periods displayed on the website. Users may deposit their luggage and belongings only in the locker or lockers booked and exclusively during the contracted booking period. Once the contracting process is completed and payment is confirmed, the user will receive the information necessary to use the service, including, where applicable, the booking confirmation, access codes and instructions for use of the locker. 4.3. Access to the locker The service is designed to be available 24 hours a day, 365 days a year, except for technical incidents, maintenance work, security reasons, force majeure or circumstances beyond the reasonable control of LOCK & GO IBIZA. The user shall be responsible for correctly keeping and using the access code and for not sharing it with third parties. Any use of the locker using the code provided to the user shall be presumed to have been made by the user or by a person authorised by the user. LOCK & GO IBIZA - Legal documentation Page 6 4.4. Price The price of the locker shall be the price indicated on the website at the time of contracting, depending on the size of the locker selected, the duration of the booking and any applicable promotions or discounts. Unless otherwise indicated, prices include applicable taxes. Any additional amount generated by extended use, delay, penalties, damage, administrative management or other contractual breaches may be charged in accordance with these terms. 4.5. Booking and contracting process To contract the service, the user must:  Be at least 16 years old. If the user is a minor, they must have the authorisation of their legal guardians.  Provide truthfully the information requested in the booking form.  Select the date, duration, locker size and number of lockers needed.  Accept these General Terms, the Privacy Policy and any other applicable legal texts.  Pay the corresponding price through the payment method enabled on the website. After contracting, the user will receive confirmation by email or by the communication channel enabled by the platform, with the details of the booking and access instructions. 4.6. Locker sizes The user shall be responsible for verifying, before booking, that the size selected is suitable for their luggage. LOCK & GO IBIZA shall not be liable if the user books a locker that is too small for their luggage or belongings. Luggage must fit completely inside the booked locker, without forcing the door, locks or mechanisms and without leaving items outside the reserved space. 4.7. User obligations The user undertakes, in particular and without limitation, to:  Use only the locker or lockers booked and only to store items owned or lawfully possessed by the user.  Use the service diligently, lawfully and in accordance with these terms.  Verify the size of their luggage before booking and avoid overloading the locker.  Ensure that the locker is properly closed after each use.  Immediately notify LOCK & GO IBIZA of any damage, anomaly, blockage, malfunction or suspicious situation.  Not share the security code with third parties and not use the locker as a means of exchanging goods between different parties.  Remain on the premises only for the time strictly necessary to deposit or collect luggage.  Not eat, drink, smoke, remain unnecessarily on the premises or disturb other users.  Not take photographs or videos of security systems, locks, cameras, screens, mechanisms or other technical elements without authorisation.  Withdraw all belongings before the end of the contracted period.  Comply at all times with instructions displayed on the premises, on the website or issued by LOCK & GO IBIZA staff or authorised providers. 4.8. Prohibited items It is strictly prohibited to deposit in the lockers:  Cash, jewellery, watches, precious stones, precious metals or high-value goods.  Passports, identity documents, travel documents, tickets, visas or documents necessary for travelling or identification. LOCK & GO IBIZA - Legal documentation Page 7  Laptops, tablets, mobile phones, professional cameras, drones, electronic devices, data storage media or professional equipment.  Works of art, antiques, collectibles or items of sentimental or economic value.  Weapons, ammunition, explosives, fireworks or any dangerous object.  Illegal substances, narcotics or goods whose possession, transport or trade is unlawful.  Inflammable, corrosive, toxic, radioactive, chemical, biological or hazardous materials.  Damaged batteries, defective electronic cigarettes or devices that may create a fire risk.  Live animals, organic remains, perishable food, liquids that may spill, objects with bad odour or items likely to deteriorate.  Any object that may damage the facilities, affect other users or endanger the security of the premises. The user declares that they are aware of and accept that breach of this obligation may lead to removal of the goods, immediate termination of the contract, charging of penalties, claims for damages and, where appropriate, notification to the competent authorities. 4.9. Maximum value of deposited goods The user undertakes not to deposit in the locker goods whose combined value exceeds 300 euros per locker and booking. LOCK & GO IBIZA shall not be liable for goods whose value exceeds this limit or for items expressly prohibited or excluded under these terms. LOCK & GO IBIZA shall not be liable for loss of flights, ferries, trains, buses, bookings, connections, appointments, events or any other indirect loss arising from the deposit of documents, tickets, devices or belongings in the locker. 4.10. Incidents and assistance In the event of breakdown, blockage, inability to open, code error, misuse or any incident related to the service, the user must immediately contact LOCK & GO IBIZA by telephone at +34 687 141 819 or by email at info@lockandgoibiza.com. LOCK & GO IBIZA will make its best efforts to resolve the incident as soon as reasonably possible, taking into account the nature of the issue, technical availability, operational support hours and any circumstance beyond its reasonable control. 4.11. Excess time, removal and storage of luggage The user must remove their belongings before the end of the contracted period. If the user exceeds the booking time, the amounts corresponding to additional days or periods shall automatically accrue according to the rates in force. Once 48 hours have elapsed since the end of the contracted period without the user having removed their belongings or regularised the situation, LOCK & GO IBIZA may open the locker, remove the deposited items and transfer them to a storage area or another locker, without accessing their contents except where strictly necessary for security, legal or operational reasons. The removal and management of luggage after expiry shall generate an administrative penalty of 100 euros, in addition to extra charges accrued for the excess time and any reasonable opening, handling, custody or management costs that may apply. Removed belongings will be kept for a maximum period of 15 calendar days from their removal. Once this period has elapsed without the user claiming them, regularising outstanding amounts and arranging collection, the belongings shall be presumed abandoned and LOCK & GO IBIZA may manage them in accordance with applicable regulations. Prohibited, dangerous, perishable, unhealthy, foul-smelling or potentially damaging products may be removed, destroyed or handed over to the authorities without waiting for the above period. Opening of lockers for security or legal reasons LOCK & GO IBIZA may open a locker without prior authorisation from the user where there are reasonable indications of risk to the premises, other users, third parties or compliance with legal obligations, or where requested by competent authorities. Where necessary, LOCK & GO IBIZA may request the presence of law enforcement agencies, emergency services, authorised technicians or any competent authority. 4.13. Damage to facilities or lockers The user shall be responsible for any damage caused, directly or indirectly, to lockers, locks, screens, terminals, cameras, electrical systems, security systems, furniture, walls, doors, signs or any other element of the premises. In the event of intentional damage, negligent use, tampering, forced opening or any action requiring repair or replacement, the user must pay the full cost of repair or replacement up to an initial maximum of 1,000 euros, without prejudice to higher damages that are effectively proven and may be claimed. LOCK & GO IBIZA reserves the right to claim any damage, loss, technical cost, loss of profit, travel expense, cleaning, repair, replacement or third-party intervention arising from misuse of the service. 4.14. Obligations of LOCK & GO IBIZA LOCK & GO IBIZA undertakes to make the contracted locker available to the user in reasonable conditions of use, to keep the booking and access system operational to the extent technically possible, and to attend to incidents reported by the user with reasonable diligence. LOCK & GO IBIZA may carry out maintenance, updates, repairs, improvements or system checks, seeking to minimise inconvenience to the user where possible. 4.15. Limitation of liability and insurance LOCK & GO IBIZA provides a temporary automated space rental service for luggage. The user is responsible for the goods deposited, their value, lawfulness and suitability for storage in an automated locker. LOCK & GO IBIZA's maximum liability for loss, damage or theft of deposited goods shall be limited to 300 euros per locker and booking, exclusively where the incident is directly attributable to LOCK & GO IBIZA and is covered by the applicable insurance policy. For any claim for theft, loss or damage, the user must immediately report the incident, provide sufficient proof of the value of the goods claimed and, in the event of theft or criminal offence, file the corresponding report with the competent authorities. Excluded from any cover or liability are prohibited or not recommended items under these terms, including cash, jewellery, watches, documents, passports, tickets, electronic devices, data storage media, artworks, antiques, goods exceeding the value limit, perishable goods, illegal items, dangerous items or any other items expressly excluded. Under no circumstances shall LOCK & GO IBIZA be liable for indirect damages, loss of profit, loss of opportunity, loss of bookings, flights, ferries, trains, buses, events, stays, connections, appointments or any other loss arising from the user's decision to deposit specific goods in the locker. 4.16. Force majeure and third parties LOCK & GO IBIZA shall not be liable for breaches, delays, interruptions, losses or damages arising from force majeure, unforeseeable events, power cuts, network outages, technology provider failures, payment platform failures, vandalism, fire, flood, meteorological events, public authority decisions, strikes, transport interruptions or any other circumstance beyond its reasonable control. LOCK & GO IBIZA - Legal documentation Page 9 4.17. Complaints The user may submit complaints, queries or claims by writing to info@lockandgoibiza.com. LOCK & GO IBIZA will respond within a reasonable period depending on the nature of the complaint. The user may request official complaint forms where applicable and may contact the competent consumer authorities of the Balearic Islands. 4.18. Amendments to the terms LE MIRAGE IBIZA S.L. reserves the right to amend these General Terms at any time. The terms applicable to each booking shall be those in force and published on the website at the time of contracting, unless legally mandatory changes apply. 4.19. Applicable law and jurisdiction These General Terms shall be governed by Spanish law. Any dispute arising from the contracting or use of the service shall be submitted to the Courts and Tribunals of Ibiza, unless applicable consumer regulations establish another mandatory jurisdiction. 5. CANCELLATION AND REFUND POLICY 5.1. Cancellation by the user The user may cancel the booking with the right to a full refund provided that the cancellation is requested at least 24 hours before the start of the booked period. Cancellations requested with less than 24 hours' notice, once the booked period has started or when the user does not use the contracted locker, shall not entitle the user to a refund, except in the case of a technical incident directly attributable to LOCK & GO IBIZA that prevents the provision of the service. 5.2. Modifications Requests to modify the date, duration, locker type or number of lockers shall be subject to availability and to the technical conditions of the booking platform. LOCK & GO IBIZA does not guarantee that a booking can be modified once confirmed. 5.3. Refunds Approved refunds will be made, where technically possible, using the same payment method used by the user for contracting. Refund processing times will depend on the relevant bank, payment platform or financial provider. 5.4. Technical incidents If a technical incident directly attributable to LOCK & GO IBIZA prevents the user from accessing the contracted locker and no reasonable alternative solution can be offered, the user shall be entitled to a refund of the amount paid for the unused service. 5.5. Exclusions No refund shall be due where the inability to use the service is due to incorrect data provided by the user, loss of access code, lack of access to their email, incorrect choice of locker size, arrival outside the booked period, misuse of the system, breach of these terms or causes beyond the control of LOCK & GO IBIZA
